These Terms of Use govern your access to and use of ecology.yoga (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About the Site

The Site is an online community platform for the study and practice of traditional yoga and ecological awareness. It includes a Community Hub (forums, groups, events, member profiles), a School (online courses), an eMag (articles, podcasts, an online library), and a Shop (books and eco-friendly products). The Site is operated by Eco-Yoga Institute, based in New South Wales, Australia.

2. Accounts and Registration

To access certain features of the Site, you must create an account. When registering, you agree to provide accurate and current information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you become aware of any unauthorised use of your account, notify us immediately at admin@ecology.yoga.

We may suspend or terminate your account at our discretion if we reasonably believe you have breached these Terms.

3. Membership Tiers

The Site offers tiered memberships: Visitor (free), Member (paid), and Instructor (paid). Details of pricing, features, and billing frequency are described on the membership page at the time of sign-up. Paid memberships are recurring subscriptions billed through our payment processors (Stripe and/or PayPal). You may cancel your membership at any time through your account settings. Cancellation takes effect at the end of your current billing period. Refunds are handled in accordance with Australian Consumer Law.

4. Acceptable Use

You agree not to:

(a) Post or transmit any material that is unlawful, defamatory, threatening, harassing, abusive, hateful, obscene, or that infringes any third party’s intellectual property or privacy rights.

(b) Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

(d) Use the Site to send unsolicited commercial messages (spam) to other users.

(e) Attempt to gain unauthorised access to any part of the Site, other users’ accounts, or any systems or networks connected to the Site.

(f) Interfere with or disrupt the Site or its servers, including by transmitting viruses, malware, or excessive traffic.

(g) Scrape, crawl, or use automated tools to extract content from the Site without our prior written consent.

(h) Use the Site for any purpose that violates applicable law.

We are not obligated to monitor user-posted content but may do so at our discretion. We may remove any content that we reasonably determine violates these Terms, and we may suspend or terminate the accounts of users who violate them.

5. User Content

“User Content” means any material you post, upload, or otherwise make available through the Site, including forum posts, group discussions, comments, course reviews, profile information, and any other contributions.

You retain ownership of your User Content. By posting User Content to the Site, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your User Content on and through the Site for the purpose of operating and promoting the Site. This licence ends when you delete your User Content or your account, except where your content has been shared with or relied upon by other users (for example, forum threads where others have responded).

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to post it and that it does not infringe any third party’s rights.

6. Instructor Accounts

Members with Instructor-tier accounts may publish courses, video, audio, and written content through the Site’s publishing tools. Instructors are solely responsible for the accuracy and quality of the content they publish. We do not endorse Instructor content and are not liable for it. Instructors retain ownership of their published content, subject to the licence granted in Section 5.

7. Intellectual Property

All Site content created by us — including text, graphics, logos, design elements, and the overall look and feel of the Site — is owned by or licensed to Eco-Yoga Institute and is protected by copyright and trademark law. “Matri,” “Eco-Yoga,” and associated logos are trademarks of Eco-Yoga Institute or its related entities. You may not copy, modify, distribute, or create derivative works from our content without our prior written consent.

8. Shop and Purchases

Products sold through the Shop are processed via WooCommerce using Stripe and/or PayPal as payment processors. Your payment information is submitted directly to the relevant payment processor and is not stored by us. Product descriptions, pricing, and availability are subject to change. We make reasonable efforts to ensure accuracy but do not guarantee that all product information is error-free.

Your rights as a consumer under the Australian Consumer Law are not affected by these Terms. Goods and services come with guarantees that cannot be excluded under Australian Consumer Law. If a product has a major failure, you are entitled to a replacement or refund. If a product has a minor failure, we will repair or replace the product within a reasonable time, or you may request a refund.

9. Affiliate Links

The Site contains affiliate links, including links to Amazon.com.au and other third-party retailers. ecology.yoga is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon. We may earn a commission on qualifying purchases made through these links at no additional cost to you. Affiliate relationships do not influence our editorial content.

10. Third-Party Links and Services

The Site may contain links to third-party websites and services. We do not control and are not responsible for the content, privacy practices, or availability of third-party sites. A link does not imply endorsement. Your use of third-party sites is at your own risk and subject to their own terms and policies.

11. Disclaimer

The Site provides general information about yoga, ecology, and related topics. It is not a substitute for professional medical, health, legal, or financial advice. You should consult a qualified professional before acting on any information obtained through the Site.

To the maximum extent permitted by law, the Site is provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no representations about the accuracy, reliability, or completeness of any content on the Site, including content posted by users and Instructors.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

12. Limitation of Liability

To the maximum extent permitted by law:

(a) We are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site.

(b) Our total aggregate liability to you for any claims arising out of or in connection with these Terms or your use of the Site is limited to the greater of AUD $100 or the total fees you have paid to us in the 12 months preceding the event giving rise to the claim.

These limitations apply to the fullest extent permitted by law but do not limit or exclude liability that cannot be limited or excluded under Australian Consumer Law.

13. Indemnification

You agree to indemnify and hold harmless Eco-Yoga Institute and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Site, your User Content, or your breach of these Terms.

14. Copyright Complaints

If you believe that material on the Site infringes your copyright, please contact us at admin@ecology.yoga with a description of the copyrighted work, identification of the infringing material, your contact details, and a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of New South Wales.

16. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. If we make material changes, we will notify registered users by email. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
